So basically there is an unidentified body in the second floor of the construction house on 67thway and you decide not to Identify it in means that someone else may come up there with you and also skip identifying it. In which you can kill them for it.

But the catch is that you're not exactly watching the body/1st entry the entire time cause you know there are only 2 possible ways up to that area. So if you only watch the 2nd way up and the body is right in the path of the 1st entry you can use common sense to know they passed an unidentified body. And of course you'd be watching if any bodies at all have been identified in the top right corner and checking back at the body making sure that wasn't the one being identified.

Also to add another question: Can you do this within the rules if you "play" with the setup of the scene as in move the body and/or bring the body from a different location?

Here's kinda what I'm getting as well:

I originally thought "As long as you are not a detective this is a viable strategy. You would also have to confirm that you are the only one up there first." but then I remembered that you can prop surf up there as well. Would that no change the scenario?

So I guess if that were a case I'd have to be able to determine they didn't, by with hearing the ladder being used sound/know which direction they came from whether it was from the body or not

This was marked unanswered for quite some time.
Pacifist is correct in that prop surfing will break the scenario brought forward as you cannot guarantee the player would have seen the unidentified body.

The second part of the question I'll seek to clarify: Can you move the body from a different location?
A clarification on this ruling was made in March 2019 from the lead at the time. A detective has the freewill to not actively identify bodies in situations of self preservation however, a detective does not have the right to plant unidentified bodies. Innocents have the right to plant bodies within reason. This isn't reflected all too well in the current extended rules and as such I'll start a discussion with the lead admins to see if we can get this more adequately represented.
